1519822 B.C. LTD, trading as FluxRemit ("Company", "we", "us", or "our"), is committed to protecting the privacy of personal information in our custody or control. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy law.
1. Information We Collect
We collect personal information necessary to provide our services, verify customer identity, manage business relationships, and comply with legal and regulatory obligations. This may include: full name, date of birth, nationality, residential and mailing address, contact details, and government-issued identification; where applicable, occupation, source of funds, source of wealth, and beneficial ownership information; bank account and payment details relevant to transactions; and technical information collected automatically when you visit our website, such as IP address, browser type, and usage data.
2. How We Collect Information
Personal information is collected directly from you during onboarding, through your use of our services, and through communications with us. We may also obtain information from identity verification providers, sanctions screening providers, financial institutions, and public registers, where necessary for legitimate business or regulatory purposes.
3. How We Use Personal Information
We use personal information to establish and manage customer relationships, verify identity, process transactions, provide customer support, and communicate with customers. As a regulated money services business, we also use personal information to perform customer due diligence, transaction monitoring, sanctions screening, and regulatory reporting under the PCMLTFA.
4. Legal Basis for Processing
We process personal information on the basis of consent, the performance of a contract, compliance with legal and regulatory obligations, and legitimate business interests, consistent with the requirements of PIPEDA. Where we rely on consent, you may withdraw it at any time, subject to legal or contractual restrictions.
5. Disclosure of Personal Information
We do not sell or rent personal information. We may disclose personal information to service providers that support our operations, including identity verification, sanctions screening, cloud hosting, and IT security providers, and to banks, payment institutions, and other parties involved in processing a transaction. We may disclose personal information to FINTRAC and other competent authorities where required by law, and such disclosures may occur without notice where notification is prohibited by law.
6. International Transfers
Personal information may be processed or stored by service providers located outside Canada. Where this occurs, we take reasonable steps to ensure appropriate contractual and security safeguards are in place, consistent with PIPEDA's accountability requirements. Personal information processed abroad may be subject to lawful access by courts, regulators, or authorities in that jurisdiction.
7. Retention
We retain personal information only as long as necessary to fulfil the purposes for which it was collected and to satisfy legal and regulatory requirements, including the recordkeeping periods prescribed under the PCMLTFA and its regulations. Once retention is no longer required, information is securely deleted or anonymised.
8. Security
We maintain administrative, technical, and physical safeguards proportionate to the sensitivity of the information we hold, designed to protect it against unauthorised access, disclosure, loss, or misuse. No method of transmission or storage is completely secure, and we encourage appropriate caution when sharing information electronically.
9. Your Rights
Subject to applicable law, you may request access to the personal information we hold about you, request correction of inaccurate information, and withdraw consent where consent is the basis for processing. We may decline a request where disclosure is prohibited by law, relates to an ongoing investigation, or where records must be retained for regulatory purposes.
If you are not satisfied with our response to a privacy request or complaint, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada (OPC), which oversees compliance with PIPEDA.
10. Cookies
We use cookies and similar technologies as described in our Cookie Policy.
